7 Abstract The title of the thesis: Crime of murder and manslaughter under section 140, 141 of the criminal code Abstract: This thesis focuses on the most serious crimes against human life, namely the crimes of murder and manslaughter under sections 140 and 141 of Act No. 40/2009 Coll., The Criminal Code. The aim of this work is to describe both of these crimes in detail, to explain the importance of punishing these crimes, to explain the reason for introducing the crime of manslaughter in our legal system, its significance, and how it differs from murder and makes it a privileged crime to the crime of murder. The purpose of this work is also, among other things, to describe the procedure of criminal investigators in the investigation of these crimes and the methodology of the investigation of intentional crimes against life. In the first part of this thesis I deal with the historical development of the legal regulation of intentional killings in our territory, starting from ancient Rome and ending in 2009, when the current Criminal Code was issued. I focus on the most important legislation that has been issued throughout history and how it regulated intentional killings. Resumé The goal of this thesis is to analyse corpora delicti of the crimes of murder and manslaughter according to sections 140 and 141 of the Criminal Code, evaluate their present application by Czech courts, and to point out possible solutions to some problematic or unclarified questions. In the beginning, the thesis concerns itself with historical development of intentional homicides in the Czech country with emphasis on great codifications of 18th and 19th century. Subsequently, the interest shifts onto the question of human life as an object of intentional homicides. The core of the thesis is a thorough analysis of the crimes of murder and manslaughter, their mutual relation, and systematic incorporation in the Criminal Code. After that, there follows a short comparative assessment of the same topic in French law according to Code pénal. Then, attention is paid to developmental stages of mentioned crimes. The chosen topic is methodologically addressed in a way that every subtopic is first examined from the doctrinal theoretical point of view, and then treated in the light of judicial practice. This thesis called "Crime of murder under Section 140 of the Criminal Code, criminal-law and criminological aspects" focuses mainly on description of variety aspects connected with the above mentioned crime. It does not thus concentrate only on a legal standpoint. In the beginning, it contains history of legal regulation of the crime of murder, depiction of punishment for such crime in a "historical" area of the Czech Republic within past centuries, as well as development of principles governing the main criminal codes (or regulations) throughout history. Term and principle of protection of the human life is, as an integral part and key term of the thesis, mentioned therein including very precise and detailed definition of the commencement and termination of the human life such moment being very important for determination whether the murder may have been, in certain cases, committed or not. Actually, right to life is also one of essential notions used also in international-law treaties and declarations whose list is also contained in the thesis. As it follows from the title of the thesis, its core shall be (and, indeed, is) represented by the valid legal regulation of the crime of murder under Czech law. The Epicurusʼ ethic is the field of interest of this bachelor thesis. Therefore, the one of Epicurusʼ own preserved systematical treatment about ethic, Letter to Menoeceus, provides the textbasis of this work. The analysis of this text shows that usual interpretations of Epicurusʼ ethic are missleading. Epicurus can not be understood as a propagator of some primitive type of hedonism and egoism. The central argumet of this bachelor thesis is that Epicurus should not be taken as a representative and adviser of private and quite apolitical life. The main objective of this work is to compare the protection of persons with disabilities in emergencies in the home with the protection of persons with disabilities in social facilities. Your research in the framework of this work will be to visit households with disabled persons residing in villages and in the town Ceske Budejovice and surroundings. This work focused on the findings of a similar situation in institutions located in the surroundings of České Budějovice.

This thesis deals with the crimes of murder and manslaughter which are regulated under section 140 and 141 of the effective criminal code. The main objective of this thesis is to perform an analysis of the bodies of the mentioned crimes with the help of specialised literature and case law. This thesis is divided into seven parts further split into chapters and points. The first part, which is focused on the historical development of the examined crimes, especially in the period from the foundation of the independent Czechoslovakia to the moment of the enactment of the current criminal code, is split into two chapters. The dividing line between these chapters is the "legal biennial," more precisely the moment of the enactment of the criminal code from 1950 that unified and simplified the existing regulation of the intentional killings as well as the substantive criminal law as a whole. The second part is also divided into two chapters and it places the crimes of murder and manslaughter into a wider context of the first head of the special part of the criminal code and of the systematics of the intentional killings as well. The thesis deals with the essence and importance of clinical pastoral care in perinatal centers (focusing on the family) and the possibilities of subsequent pastoral care. This problematics opens up brief descriptions of the family and the treatise on the pregnancy and the child. The following is an introduction by field of perinatology and outline of care in the perinatal centers (with a preferential view of the risk department and pathological pregnancy, the obstetrical hall, neonatological JIRP and the puerperology department). The selected are risk and pathological conditions in the perinatology are mentioned , as well as the specific conflicting situations in perinatology . The following outline is problematics at the beginning of an individual human life, which goes into another very controversial question, touching the human right to a (healthy) child and a look at ethical reproduction problems. Furthermore, the work is already focused on the definition of the essence and importance of clinical pastoral care in the perinatal centers and in the area of possibilities of subsequent pastoral care. Crime of murder under section 140 of the criminal code: criminal law, criminological and criminalistic aspects Abstract This thesis is intended to provide the reader with a comprehensive overview of the crime phenomenon of murder not only from a criminal law point of view, but also from a criminological and criminalistic point of view. Before the analysis of the actual questions is first described the history of the legal regulation of murders in the territory of nowadays Czech Republic, as the outline of the development and approach to punishment of murders in history serves to better understand the form of the present arrangement and its meaning. Subsequently, the term human life is described, in which it is important to define its beginning and end, as it is highlighted that it is the object of the murder crime and the most important criminal code protected by the interest. After that, the issue of the crime of murder from the point of view of criminal law is already addressed, especially by its inclusion within the system of intentional killing, which is contained in the current Criminal Code. At the beginning, the elements of a crime of murder are characterized and typified. This Thesis deals with views of active seniors on the issue of death. The Thesis looks into problems of old age, which is a natural part of human life. In this context, the Thesis also concerns the third age and the active old age. In the Thesis, there are characterized some leisure activities for seniors to fulfil their free time in meaningful ways. Plenty of free time is a typical characteristic of a person who has left the labour market and become a pensioner. The Thesis also describes the phenomenon of death and dying. For some people nowadays, this issue is often a very uncomfortable topic. They would like to eliminate death from the whole human society because death is connected with terrible pain and suffering. In this part of the Thesis, there are introduced two real human stories. Two members of my own family who have their own experience associated with death tell us their stories to express their views on the issues of death and dying.
